Data privacy notice of Fábrica Electrotécnica JOSA, SAU (hereinafter, “BJC”).

BJC considers it important to protect the security and privacy of your personal data. Therefore, BJC (for more details about the company, please see the “Corporate Information” below) processes personal data in accordance with applicable data protection and security legislation.

1. Processing of personal data related to the use of our websites, applications and online platforms

Categories of personal data processed, purpose of processing and legal basis

When you visit BJC websites, applications, or online tools, BJC may process the following personal data about you:

  • Personal data that you actively and voluntarily provide through the BJC Websites (for example, when registering, contacting us with your queries or participating in surveys, etc.), including name, email address, telephone number, information submitted as part of a support request, comments or forum messages, etc.; and
  • Information that your web browser or device automatically sends us, such as your IP address, device type, browser type, referring site, sites accessed during your visit, and the date and time of each visit request.

We process your personal data for the following purposes:

  • To provide the services and functions of the BJC Websites and to manage their use;
  • To verify your identity (if you have registered on the BJC Websites);
  • Respond to and fulfill their specific requests; and
  • As reasonably necessary to enforce applicable terms of use, to establish or preserve a legal claim or defense, to prevent fraud or other illegal activities, including attacks on BJC’s information technology systems.

The processing of your personal data is necessary for the purposes mentioned above. Unless otherwise stated at the time of collection, our legal basis for processing personal data is that:

  • You have given your express consent to the processing of your personal data (Article 6, paragraph 1, letter a), of the General Data Protection Regulation);
  • The processing is necessary for the performance of a contractual relationship with you [Article 6(1)(b) of the General Data Protection Regulation].
  • Otherwise, the processing is necessary for the effective execution or management of its use [point f) of paragraph 1 of Article 6 of the General Data Protection Regulation].

2. Processing of personal data related to your business relationship with BJC

Categories of personal data processed, purpose of processing and legal basis

In the context of the business relationship with BJC, BJC may process the following categories of personal data of current and prospective contact persons in our customers, suppliers, vendors and partners (each of them a “business partner”):

  • Contact information, such as full name, work address, work phone number, work mobile phone number, work fax number, and work email address;

  • Payment data, such as data necessary for payment processing and fraud prevention, including credit/debit card numbers, security codes and other related billing data;

  • Additional information necessarily processed in a project or contractual relationship with BJC or voluntarily provided by the business partner, such as personal data relating to orders placed, payments made, requests and project milestones;

  • Personal data collected from public resources, integrity databases, and credit agencies; and

  • If legally required for Business Partner compliance assessments: date of birth, identification numbers, identity cards, and information on relevant and significant litigation or other legal proceedings against Business Partners.

BJC may process personal data for the following purposes:

  • Communicating with business partners about BJC products, services and projects or business partners, for example, by responding to inquiries or requests or providing technical information about purchased products;

  • Planning, execution and management of the (contractual) relationship with business partners, for example, by carrying out transactions and orders for products or services, processing payments, accounting, auditing, billing and collection activities, organizing shipments and deliveries, facilitating repairs and providing support services;

  • Administration and management and execution of customer surveys, marketing campaigns, market analysis, raffles, contests or other promotional activities or events;

  • Maintaining and protecting the security of our products, services and websites, preventing and detecting security threats, fraud or other criminal or malicious activities;

  • Ensuring compliance with legal obligations (such as record-keeping obligations), export and customs controls, trading partners’ compliance monitoring obligations (to prevent money laundering or related offenses), and BJC’s industry policies or standards; and

  • To resolve disputes, enforce our contractual agreements, and establish, exercise, or defend legal claims.

The processing of personal data is necessary for the purposes mentioned above. Unless otherwise stated at the time of collection, our legal basis for processing personal data is that:

  • You have given your express consent to the processing of your personal data (Article 6, paragraph 1, letter a), of the General Data Protection Regulation);

  • The processing is necessary for the performance of the contractual relationship with you [Article 6(1)(b) of the General Data Protection Regulation].

  • The processing is necessary for the proper functioning or management of our business relationship with you (Article 6, paragraph 1, letter f), of the General Data Protection Regulation).

3. Transmission and communication of personal data

BJC may transfer personal data to other Elko EP companies or to third parties, but only if and to the extent that such transfer is necessary for the purposes mentioned above.

If permitted by law, BJC may transfer personal data to courts, law enforcement authorities, regulators, or lawyers, if necessary to comply with the law or for the establishment, exercise, or defense of legal claims.

BJC entrusts service providers (referred to as data processors), such as hosting or IT maintenance service providers, who act only on BJC’s instructions and are contractually obligated to act in accordance with applicable data protection law.

The recipients of personal data may be located in countries outside the European Economic Area (“third countries”), where applicable laws do not offer the same level of data protection as the laws of the individual’s country of origin.

In such cases, BJC takes steps to implement appropriate and adequate safeguards for the protection of personal data by other means.

  • We transfer personal data to external recipients in third countries only if the recipient (i) has entered into EU Standard Contractual Clauses with BJC, (ii) has implemented binding corporate rules within their organization, or (iii) – in the case of US recipients – is certified under the Privacy Shield . Data subjects may request further information and copies of the safeguards by contacting BJC.

4. Retention periods

Unless explicitly stated otherwise at the time of collection of personal data (for example, by means of a consent form accepted by you), we delete personal data if the retention of the personal data is no longer necessary for the purposes for which it was collected or otherwise processed and there is no legal retention obligation under applicable law (such as tax or commercial law) that requires us to retain the personal data.

5. Right to withdraw consent

If you have given your consent for BJC to process certain personal data, you have the right to withdraw that consent at any time with effect for the future. This means that withdrawing consent does not affect the lawfulness of processing based on consent before its withdrawal. If you withdraw your consent, BJC may only continue to process your personal data if there is another legal basis for doing so.

6. Right of access, rectification or erasure of personal data, restriction of processing, right to object to processing and right to data retention.

In accordance with applicable data protection law, you may – provided the relevant legal requirements are met – have the right to:

  • Obtain from BJC confirmation as to whether or not personal data concerning you is being processed and, where applicable, access to the personal data;

  • Obtain from BJC the rectification of incorrect personal data concerning you;

  • Obtain from BJC the deletion of your personal data;

  • Obtain from BJC the restriction of the processing of your personal data;

  • Data portability regarding personal data that you have actively provided; and

  • To object, on grounds related to their particular situation.
